Terms of Service

CAPS helps AMC exam candidates get AI study explanations, save notes on a canvas, and (via the Extension) attach highlighted or page text from HTTPS qbanks. You must be 18 or older. The Service is offered internationally and is governed primarily by the laws of Pakistan; mandatory laws of your country or state may also apply.

Keep your credentials confidential and your registration details accurate. We may suspend or terminate accounts that abuse the Service, bypass limits, or breach these Terms. You can delete your account in Profile: access ends now, billing is cancelled, and data stays recoverable for 30 days if you sign in with the same email. Export remains by email to tmk@capsapp.xyz within 30 days.

Access tiers may include free, beta, trial, standard, and premium, with different daily AI caps shown in-product. CAPS-owned trials may be granted after onboarding or via referral/partner variants.

Paid plans are sold through Creem (Merchant of Record). You authorise Creem to charge checkout fees; manage billing via the customer portal where available. Cancel generally at the end of the current billing period unless the portal states otherwise.

Refunds: email tmk@capsapp.xyz. For a first paid Standard charge we may consider a refund within 14 days if paid AI usage was minimal or unused, case by case. Later or heavy-usage charges are generally non-refundable except where mandatory consumer protection or other non-excludable law in Pakistan or your country or state requires otherwise. Payment failures or disputes may place the account on hold or block AI features.

Use CAPS only for lawful personal exam preparation. Do not submit real patient-identifiable data; violate third-party qbank terms; scrape or resell the Service; bypass security or rate limits; or use outputs for clinical care or emergencies.

The Extension may read selected text, a truncated page excerpt, and the page URL when you use Ask CAPS, Context, or related features, then send that data to our servers. We do not control third-party websites. You must have the right to process any text you send us.

AI output can be incomplete or wrong. CAPS provides study aids only—not medical advice, not diagnosis, and not official AMC guidance. You are responsible for how you use outputs. Nothing here creates a doctor–patient relationship.

Free, beta, and trial usage may run on Google’s unpaid Gemini tier (Google may use that content to improve its products under current unpaid terms). Paid standard/premium usage runs on our paid Gemini tier (Google’s current Paid Services terms: no use of prompts/responses to improve Google products). CAPS does not train its own models on your content. Groq does not train on inputs/outputs without permission; we do not grant that permission.

CAPS software and branding remain ours. You keep ownership of content you submit and grant us a licence to host and process it to operate the Service (including AI providers). Subject to provider terms and law, we assign to you rights we can in specific outputs generated for your account for personal study. Feedback may be used to improve CAPS without obligation to you.

The Service is provided “as is” and “as available.” Features, models, and caps may change. Outages and upstream AI limits may occur.

Mandatory consumer or similar rights in Pakistan or your country or state are not excluded where they cannot be waived by contract. Where we may limit remedies for a non-excludable guarantee, liability is limited to resupplying the services or paying the cost of resupply.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, exam outcomes, or reliance on AI output. Subject to non-excludable law, our aggregate liability in any 12-month period is limited to the greater of amounts you paid for CAPS in that period or USD $50 if you are on a free plan.

These Terms are governed by the laws of Pakistan. Disputes are subject to the exclusive jurisdiction of the courts of Pakistan, without prejudice to non-excludable consumer, privacy, or other statutory rights where you live. There is no arbitration clause.

We may update these Terms by posting a revised version. Material changes will be communicated by reasonable means. Continued use after the effective date constitutes acceptance.
